All dealings with Australia Tourist Guide will be on these Terms and Conditions unless otherwise agreed in writing with Australia Tourist Guide.

1. Australia Tourist Guide reserves the right to add, withdraw, substitute and/or vary advertised routes, prices and departure times for tours without notice. However, reasonable effort will be made to maintain arrangements as advertised.
   
   
2. Requirements to participate in Australia Tourist Guide tours: 
   
   
   1. All Participants will be required to disclose any medical conditions, including but not limited to: epilepsy, dizziness, limb or back injury, angina or other heart conditions, severe or uncontrolled asthma, visual impairment, depression or recovering from recent surgery.
      
      
   2. The Participant acknowledges and agrees that he/she participates in the tour at their own risk. 
      
      
3. Australia Tourist Guide reserves the right to refuse any person participation in the tour on the grounds of disruptive behaviour, without a refund
   
   
4. During the tour, all Participants must obey the directions and instructions of the guide, and must not disturb other Participants or interfere with the guide’s ability to conduct the tour in a safe manner.
   
   
5. Miscellaneous Terms:
   
   
   1. All Participants give permission for photographs of participants taken during the tour to be used for the purposes of advertising or displayed on the website
      
      
   2. Participant photographs remain copyright to Australia Tourist Guide and may only be used or reproduced by participants for private or domestic purposes and must not be used for any commercial purpose, including promotion of any supplier or any supplier's products or services, without Australia Tourist Guide’ written permission.
      
      
6. Terms of payment:
   
   
   1. Australia Tourist Guide tickets are non-refundable (subject to Term 7(a) below) and specific to the Australia Tourist Guide specified in the booking. Australia Tourist Guide and Gift Vouchers, rights or entitlements to Australia Tourist Guide and Gift Vouchers, must not be offered for sale or resale, or resold or used for any commercial purpose, including without limitation promotion of any supplier or any supplier's products or services, without Australia Tourist Guide’ prior written permission.
      
      
   2. Bookings can not be changed within 5 days prior to the original tour date. Before this time, bookings may only be moved to another available time. Reductions in the number of participants are not available.
      
      
   3. All Australia Tourist Guide must be paid for at the time of booking unless otherwise agreed by Australia Tourist Guide.
      
      
7. Cancellation and refunds:
   
   
   1. Bookings can only be cancelled by the Participant by giving written notice to Australia Tourist Guide at least 5 days before the original tour date. 
      
      
   2. The Australia Tourist Guide will not proceed should Australia Tourist Guide decide that the weather makes the participation in the Australia Tourist Guide tour unsafe, or for any other reason, at the discretion of Australia Tourist Guide.
      
      
   3. Should a tour not proceed, participants will either be re-booked at the earliest possible time at the convenience of the participants, or be reimbursed for the price paid for the tour. 
      
      
   4. There will be no other refunds of a tour by Australia Tourist Guide except in accordance with these terms or as agreed in writing by Australia Tourist Guide. Refunds will only be made to the person who purchased the ticket from Australia Tourist Guide.
      
      
8. Australia Tourist Guide liability:
   
   
   1. To the extent permitted by law, Australia Tourist Guide excludes liability and will not be responsible for any loss, damage or injury arising from or connected with the Australia Tourist Guide, no matter how that loss, damage or injury is caused. In particular, Australia Tourist Guide will not be responsible for loss or damage arising from a participant's failure to obey the guide's instructions or from any pre-existing medical or psychological condition. Further, but only to the extent permitted by law, Australia Tourist Guide will not be responsible for loss or damage arising from any negligent act or omission of the guide or any person for whom Australia Tourist Guide is responsible. Certain laws imply non-excludable conditions and warranties. This provision does not exclude those conditions and warranties but limits Australia Tourist Guide’ liability in relation to these to provision of services provided by Australia Tourist Guide again, or refund of the cost of those services. 
      
      
   2. Australia Tourist Guide is also not liable for any loss, damage or inconvenience arising from or incidental to any delay in the scheduled Australia Tourist Guide taking place.
